All Consoles App Terms of Service

These Terms of Service (“Terms”) govern your use of the All Consoles App (the “App”), provided by Gary Crosby, an individual developer based in the United Kingdom (“we,” “us,” or “our”). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

Our Privacy Policy explains how information is handled when you use the App.

1. What the App provides

The App includes a console emulator and a separate catalog of HTML5 games available to play within the App (“Instant Games”).

The emulator lets you import compatible game files you provide, organize your library, use supported controls, and save your progress. It does not include or provide commercial console games, ROMs, disc images, or console firmware.

Instant Games are separate from the emulator. They can be played within the App without importing game files. Some Instant Games require an internet connection. Available features, controls, and save options may differ between games.

2. Files you import

You are responsible for the files you import into the emulator and for having the rights needed to use them. Do not use the App to obtain, play, copy, or distribute games or firmware in a way that infringes another person’s rights or violates applicable law.

Owning a physical game or console does not necessarily authorize every copy or download of its software. We do not verify the origin or legal status of imported files and do not provide legal advice about any particular file.

3. Instant Games

Instant Games are offered for personal, non-commercial play within the App. Their games, characters, artwork, music, and other assets remain the property of their respective rights holders. You may not extract, reproduce, redistribute, or separately host an Instant Game or its assets without the rights holder’s permission.

We may add, update, restrict, or remove an Instant Game, including when it becomes unavailable or the rights needed to offer it change. We do not guarantee that a particular game will remain in the catalog indefinitely.

If you believe content offered in the App infringes your rights, contact [email protected]. Identify the content, describe the rights you hold, and provide your contact information. We will review the request and take appropriate action.

4. Subscriptions and purchases

The App may offer auto-renewing Premium subscriptions through Apple’s in-app purchase system. The purchase screen explains the features included with the selected subscription and displays its duration, the amount charged at purchase, any introductory offer, and the renewal price.

Apple charges your Apple Account when you confirm the purchase. A subscription renews automatically unless you cancel it through Apple before the next renewal. You can manage or cancel subscriptions in your Apple Account subscription settings. Deleting the App does not cancel a subscription.

An eligible purchase can be restored through the App’s Restore Purchases control. Subscription access is available on eligible Apple devices using the Apple Account associated with the purchase.

Apple handles App Store billing and refund requests under its policies. If a subscription price changes, Apple will provide any notice or consent required for the change to take effect.

5. Your files and saves

The files you import and the library information and local saves you create remain yours. If you enable an optional iCloud save feature, the relevant saves are stored through your Apple Account.

Keep a separate copy of game files and saves that matter to you. A save may not work with every game version, emulator version, or device. Deleting the App or removing data from your device or iCloud may remove your progress.

6. Acceptable use

You agree not to use the App to infringe intellectual property rights, violate applicable law, interfere with the App or its services, introduce malicious code, bypass purchase or security controls, or copy and distribute Instant Games without permission.

We may restrict access to online features when reasonably necessary to address misuse, protect the service, or comply with the law.

7. Ownership and trademarks

We or our licensors own the App’s software, design, and other original materials. These Terms permit you to use the App; they do not transfer ownership of the App or any game.

Console, controller, and game names may appear to describe compatibility or identify content. Unless expressly stated otherwise, the App is not affiliated with, sponsored by, or endorsed by any console manufacturer or game publisher. Their trademarks and other rights remain with their owners.

8. Availability and changes

We do not guarantee that every game file will run correctly or that every feature will always be available. Emulation accuracy and performance depend on the game, device, iOS version, and controller. Online services and Instant Games may sometimes be unavailable.

We may update the App, change supported systems or features, or discontinue an online service. Where reasonably possible, we will provide notice before removing a material paid feature. Your applicable consumer rights remain unaffected.

9. Disclaimer and liability

To the extent permitted by applicable law, the App is provided “as is” and “as available.” We do not promise that the App will be uninterrupted, error-free, or compatible with every game file.

To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of the App. Nothing in these Terms limits liability or consumer rights that cannot legally be limited.

10. Updates to these Terms

We may update these Terms when the App, our services, or applicable requirements change. The current version and effective date will be available in the App. We will provide notice of material changes where appropriate. Updated Terms apply when they take effect.

11. Contact and applicable terms

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection rules in your place of residence apply.

Apple’s Standard Licensed Application End User License Agreement applies to the license for the App unless a different license agreement is provided through the App Store.
